Storm Cellar - S3-Compatible Object Storage

1. About These Terms

These Terms of Service ("Terms") govern your access to and use of Storm Cellar, an S3-compatible object storage service operated by Storm Developments ("we," "us," or "our"), a company based in Ontario, Canada.

By creating an account or using Storm Cellar, you agree to these Terms. If you do not agree, do not use the service.


2. Alpha and Beta Status

Storm Cellar is currently in alpha testing. This is pre-production software.

This means:

  • No uptime guarantee. We do not guarantee any level of availability. The service may go down without notice for maintenance, upgrades, or failure.

  • No SLA. No service level agreement exists during the alpha period.

  • Data loss is possible. While we take reasonable precautions, you should not rely on Storm Cellar as your only copy of important data during this period.

  • Features may change. The service, pricing, and features may change significantly before general availability.

  • Access may be revoked. Alpha access is granted at our discretion and may be withdrawn at any time.

We will communicate significant changes and outages through the contact email address associated with your account and through stormdevelopments.ca.


3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Storm Cellar. By using the service, you confirm that this is the case.

If you are using Storm Cellar on behalf of an organization, you represent that you have authority to bind that organization to these Terms.


4. Your Account

You are responsible for:

  • Keeping your account credentials secure

  • All activity that occurs under your account

  • Ensuring your contact email address is accurate and current

  • Any API keys generated under your account

If you believe your account has been compromised, contact us immediately at contact@stormdevelopments.ca.

We may require you to verify your identity before granting access or responding to account requests.


5. Acceptable Use

You may use Storm Cellar only for lawful purposes and in accordance with these Terms.

You must not use Storm Cellar to store, transmit, or distribute:

  • Content that is illegal under Canadian federal law or the laws of Ontario

  • Child sexual abuse material or any content that sexually exploits minors

  • Malware, ransomware, spyware, or any malicious code intended to harm systems or users

  • Content that facilitates fraud, phishing, or identity theft

  • Stolen data or data obtained without authorization

  • Content that violates the intellectual property rights of others

  • Personal information of third parties collected without their consent

You must not use Storm Cellar to:

  • Launch denial-of-service attacks or other attacks against systems or networks

  • Attempt to gain unauthorized access to any system, network, or account

  • Circumvent storage quotas or other technical limits through artificial means

  • Resell or sublicense access to Storm Cellar without our written permission

  • Use the service in a way that places unreasonable load on our infrastructure

This list is not exhaustive. We reserve the right to determine, at our sole discretion, whether any use violates the spirit of these Terms.


6. Your Data

You own your data. Files and objects you upload to Storm Cellar remain your property. We do not claim any ownership over the content you store.

We are the processor. We store and serve your data on your behalf. We do not access, read, or analyze the content of your files except as necessary to operate the service, respond to support requests, or comply with legal obligations.

Your responsibility. You are responsible for ensuring that the data you store in Storm Cellar complies with applicable laws, including privacy laws governing any personal information you upload about third parties.


7. Data Storage and Location

All data stored in Storm Cellar is hosted on servers located in Canada, operated by Storm Developments. We do not transfer your stored data to servers outside Canada.

Account metadata (your email address, username, account settings) is stored in our Canadian-hosted database.


8. Storage Limits and Quotas

During the alpha period, storage limits may be assigned to individual accounts at our discretion. We will notify you of your assigned quota. Exceeding your quota may result in upload restrictions.

We reserve the right to adjust quotas as the service develops.


9. Account Suspension and Termination

By us. We may suspend or terminate your account, with or without notice, if:

  • You violate these Terms or our Acceptable Use Policy

  • We believe your account is being used for illegal activity

  • Continued operation of your account poses a risk to the security or integrity of the service or other users

  • We discontinue the service

In cases of serious violations (illegal content, malware, attacks on infrastructure), we may terminate immediately without prior notice.

In other cases, we will attempt to contact you at your registered email address before taking action, and give you a reasonable opportunity to respond.

By you. You may close your account at any time by contacting us at contact@stormdevelopments.ca. Upon account closure, we will delete your stored data and account information in accordance with our Privacy Policy.

Effect of termination. When an account is terminated, your access to the service ends and your stored data is deleted from our systems. We do not retain backups of deleted data after deletion is complete.


10. API Keys and Access Credentials

Storm Cellar generates API keys that grant access to your buckets. These keys are your responsibility.

  • Secret keys are displayed once and are not stored by us in recoverable form

  • If a key is lost or compromised, you must revoke it and generate a new one

  • You are responsible for all activity performed using your API keys

  • Do not embed secret keys in public repositories or client-side code


11. Limitation of Liability

To the maximum extent permitted by applicable Canadian law:

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption, arising from your use of or inability to use Storm Cellar.

Our total liability to you for any claim arising from these Terms or your use of the service will not exceed the amount you paid us in the three months prior to the claim. During the free alpha period, this amount is zero.

This limitation applies even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability for gross negligence, willful misconduct, or fraud.


12. No Warranty

Storm Cellar is provided "as is" and "as available" without warranty of any kind, express or implied.

We do not warrant that:

  • The service will be uninterrupted or error-free

  • Your data will never be lost

  • The service will meet your specific requirements

This is especially true during the alpha period. See Section 2.


13. Intellectual Property

Storm Developments owns all rights to the Storm Cellar software, platform, branding, and documentation. Nothing in these Terms grants you any rights to our intellectual property beyond the right to use the service as described.

The underlying storage software (Garage) is open source and licensed under the AGPL-3.0. Storm Pulse, our infrastructure management agent, is MIT licensed. These licenses govern those respective components separately.


14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document and notify users by email at least 14 days before changes take effect, except in cases where changes are required by law or necessary to address security issues.

Your continued use of Storm Cellar after changes take effect constitutes your acceptance of the updated Terms.


15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Ontario.
