1. About These Terms
These Terms of Service ("Terms") govern your access to and use of Storm Buckets, an S3-compatible object storage service operated by Storm Developments ("we," "us," or "our"), a company based in Ontario, Canada.
By creating an account or using Storm Buckets, you agree to these Terms. If you do not agree, do not use the service.
2. Alpha and Beta Status
Storm Buckets is currently in alpha testing. This is pre-production software.
This means:

No uptime guarantee. We do not guarantee any level of availability. The service may go down without notice for maintenance, upgrades, or failure.

No SLA. No service level agreement exists during the alpha period.

Data loss is possible. While we take reasonable precautions, you should not rely on Storm Buckets as your only copy of important data during this period.

Features may change. The service, pricing, and features may change significantly before general availability.

Access may be revoked. Alpha access is granted at our discretion and may be withdrawn at any time.
We will communicate significant changes and outages through the contact email address associated with your account and through stormdevelopments.ca.
3. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use Storm Buckets. By using the service, you confirm that this is the case.
Storm Buckets is intended for business and professional use.
If you are using Storm Buckets on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
4. Your Account
You are responsible for:

Keeping your account credentials secure

All activity that occurs under your account

Ensuring your contact email address is accurate and current

Any access keys generated under your account
If you believe your account has been compromised, contact us immediately at contact@stormdevelopments.ca.
We may require you to verify your identity before granting access or responding to account requests.
5. Acceptable Use
You may use Storm Buckets only for lawful purposes and in accordance with these Terms.
You must not use Storm Buckets to store, transmit, or distribute:

Content that is illegal under Canadian federal law or the laws of Ontario

Child sexual abuse material or any content that sexually exploits minors

Malware, ransomware, spyware, or any malicious code intended to harm systems or users

Content that facilitates fraud, phishing, or identity theft

Stolen data or data obtained without authorization

Content that violates the intellectual property rights of others

Personal information of third parties collected without their consent
You must not use Storm Buckets to:

Launch denial-of-service attacks or other attacks against systems or networks

Attempt to gain unauthorized access to any system, network, or account

Circumvent storage quotas or other technical limits through artificial means

Resell or sublicense access to Storm Buckets without our written permission

Use the service in a way that places unreasonable load on our infrastructure
This list is not exhaustive. We reserve the right to determine, at our sole discretion, whether any use violates the spirit of these Terms.
6. Your Data
You own your data. Files and objects you upload to Storm Buckets remain your property. We do not claim any ownership over the content you store.
We act as a processor. We store and serve your data on your behalf. We do not access, read, or analyze the content of your files except as necessary to operate the service, respond to a support request you make, or comply with a legal obligation. Where required by law or to address illegal or abusive use, we may also restrict access to, preserve, or remove specific content or buckets, as described in Section 5 (Acceptable Use) and Section 9 (Account Suspension and Termination). Where you use Storm Buckets to process personal information, we will enter into a written data processing agreement with you on request.
We do not train on your data. We will never use the content you store in Storm Buckets to train machine learning models, ours or anyone else's.
Your responsibility. You are responsible for ensuring that the data you store in Storm Buckets complies with applicable laws, including privacy laws governing any personal information you upload about other people.
7. Data Storage and Location
Objects you store in Storm Buckets are hosted on servers located in Canada and operated by Storm Developments. We do not replicate or transfer your stored objects to servers outside Canada.
Account metadata (your email address, username, and account settings) is stored in our Canadian-hosted database.
Some limited operational processing, for example email delivery, payment processing, or support, may involve third-party service providers. Where any such provider operates outside Canada, we identify this in our Privacy Policy and remain accountable for the protection of that information under applicable Canadian law.
8. Storage Limits and Quotas
During the alpha period, storage limits may be assigned to individual accounts at our discretion. We will notify you of your assigned quota. Exceeding your quota may result in upload restrictions.
We reserve the right to adjust quotas as the service develops.
9. Account Suspension and Termination
By us. We may suspend or terminate your account, with or without notice, if:

You violate these Terms or our Acceptable Use Policy

We believe your account is being used for illegal activity
-
Continued operation of your account poses a risk to the security or integrity of the service or other users
-
We discontinue the service
In cases of serious violations (illegal content, malware, attacks on infrastructure), we may terminate immediately without prior notice.
In other cases, we will attempt to contact you at your registered email address before taking action, and give you a reasonable opportunity to respond.
Action on specific content. In addition to suspending or terminating an account, we may take narrower action against specific content or buckets, including making content private, disabling public access or website serving, or removing content, where it violates these Terms or the Acceptable Use Policy or where required by law. We report illegal content to the appropriate authorities as required by law, including reporting child sexual abuse material to the Canadian Centre for Child Protection and to law enforcement.
Notice. We will notify you of action taken on your content or account, except where notifying you is prohibited by law, would compromise an investigation, or would endanger someone.
Preservation. Where we are required by law to preserve content, for example under a preservation demand or our mandatory reporting obligations for illegal content, we will preserve it for as long as the law requires before deleting it, even if your account is terminated. This is an exception to the deletion described under "Effect of termination" below and in our Privacy Policy.
By you. You may close your account at any time by contacting us at contact@stormdevelopments.ca. Upon account closure, we will delete your stored data and account information in accordance with our Privacy Policy.
Effect of termination. When an account is terminated, your access to the service ends and your stored data is deleted from our systems, except where we are required by law to preserve it (see "Preservation" above). We do not retain backups of deleted data after deletion is complete.
10. Access Keys and Credentials
Storm Buckets issues access keys (an access key ID and a secret key) that grant access to your buckets. These keys are your responsibility.

Your secret key is shown once, when you create it. We do not display it again and cannot recover it for you. If you lose it, revoke the key and create a new one.

Storm Buckets authenticates your requests using the AWS Signature Version 4 scheme. To verify that requests are signed by you, your secret key is held on our servers in the storage engine's credential store. We use it only to authenticate your requests, and never to access the content of your stored objects.

You are responsible for all activity performed using your access keys.

Do not embed secret keys in public repositories or client-side code.
If you need protection against access by anyone who operates the service, including us, encrypt your data on your own systems before you upload it.
11. Limitation of Liability
To the maximum extent permitted by applicable Canadian law:
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or business interruption, arising from your use of or inability to use Storm Buckets.
Storm Buckets is object storage, and stored data can be lost, corrupted, or deleted, particularly during the alpha period. You are responsible for keeping an independent copy of any data you cannot afford to lose (see Section 2). To the maximum extent permitted by applicable law, we are not liable for the loss, corruption, or deletion of data you store in the service.
Our total liability to you for any claim arising from these Terms or your use of the service will not exceed the amount you paid us in the three months before the event giving rise to the claim. During the free alpha period, that amount is zero.
This limitation applies even if we have been advised of the possibility of such damages.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, willful misconduct, or fraud.
12. No Warranty
Storm Buckets is provided "as is" and "as available" without warranty of any kind, express or implied.
We do not warrant that:

The service will be uninterrupted or error-free

Your data will never be lost

The service will meet your specific requirements
This is especially true during the alpha period. See Section 2.
13. Indemnification
You agree to defend, indemnify, and hold harmless Storm Developments against any third-party claim, demand, loss, or expense (including reasonable legal fees) that arises from:

The data and content you store in, transmit through, or serve from Storm Buckets, including any claim that it is unlawful or infringes the rights of another person

Your breach of these Terms or of the Acceptable Use rules in Section 5

Your violation of any applicable law in connection with your use of the service
This obligation does not apply to the extent a claim results from our own gross negligence, willful misconduct, fraud, or breach of these Terms. Where we are named in a claim covered by this section, we may assume its defense at our own expense, and you agree to cooperate with us in that defense.
14. Intellectual Property
Storm Developments owns all rights to the Storm Buckets platform, branding, and documentation, and to the proprietary software we operate the service with. Nothing in these Terms grants you any rights to our intellectual property beyond the right to use the service as described.
The underlying storage software, Garage, is open source and licensed under the AGPL-3.0. Storm Pulse, our infrastructure management agent, is also open source and licensed under the AGPL-3.0. Those licenses govern those respective components separately.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this document and notify users by email at least 14 days before changes take effect, except where changes are required by law or necessary to address a security issue.
Your continued use of Storm Buckets after changes take effect constitutes your acceptance of the updated Terms.
16. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of Ontario.
